New environmental study on Dakota Access Pipeline officially announced by Army

The North Dakota National Guard had deployed a missile defense system to the area near the protest site, but it was unarmed and being used only for observation purposes, said Amber Balken, a spokeswoman for the North Dakota National Guard. "All this administration has done is set a risky new precedent that you may repeatedly break the law, create and spread misinformation, terrorize innocent bystanders and citizens, and step on the rights of others to get your way regardless of the legality and necessity of a project". Kempenich, who spoke to the Bismark Tribune, was completely candid in expressing that he created the legislation in response to protests against the Dakota Access Pipeline. If they don't, Kempenich said, the law should favor motorists.

"It's shifting the burden of proof from the motor vehicle driver to the pedestrian", Rep. Keith Kempenich told the paper. He added that protesters are welcomed to express their point of view for how long they want to, but they have no right to invade the motorists' driving space as this could be risky to all the parties involved.

The North Dakota legislator who is proposing the law says it wouldn't apply to people who strike Water Protectors at DAPL intentionally. One bill would make it illegal for adults to wear masks.

According to KFYR, Kempenich claims his relatives have been harassed by protesters and is anxious an accident will occur.

House bill 1203 says "an individual who negligently causes injury or death to an individual obstructing vehicular traffic.may not be held liable". Protesters - called Water Protectors - and the Standing Rock tribe say the pipeline project would endanger water sources and imperil cultural heritage sites; the pipeline's supporters say it will bring jobs and boost the economy, decreasing reliance on foreign oil.


The company building the Dakota Access oil pipeline wants a federal judge to block the U.S. Army Corps of Engineers from launching a full environmental study of the $3.8 billion pipeline's disputed crossing of a Missouri River reservoir in North Dakota. You can get a list of those banks here.

Last month, the US Army Corps of Engineers denied a key easement which would have been needed to allow the pipeline to run under Lake Oahe.

"Knee-jerk legislation often is poor legislation", Democratic state Rep. Marvin Nelson said to ABC News.

The protests have forced North Dakotans to detour for miles.
