No Prosecutor, Caffeine Highs are not DUI

The local prosecutor says that since she believes Schwab was influenced by a drug that didn't show up on the test, she'll use the loose definition of "drug" to charge Schwab with driving under the influence of the only "drug" they found, even if it means anyone pulling out of a Starbucks Drive-Thru could eventually lose their license.

It was August, 2015 when 36-year-old Fairfield, California resident Joseph Schwab was pulled over by an Alcohol Beverage Control agent for "weaving in and out of traffic nearly causing several collisions", KRCA reports.

Court documents show the agent claimed Schwab was "weaving in and out of traffic nearly causing several collisions".

According to a statement from the Solano County District Attorney's office, the officer at the scene was suspicious because of Schwab's "erratic and reckless driving" and his "demeanor" and "performance on a number of field sobriety tests".

The agent found legal workout powders inside his vehicle and conducted several field sobriety tests, in which the agent said she saw Schwab's pupils were dilated.

Krishna Abrams is Solano County's district attorney and says inside Schwab's auto.


According to Schwab's attorney, "I have not been provided with any evidence to support a theory of prosecution for a substance other than caffeine at this time".

The drug tests don't usually cover up all classifications of narcotics in general, as synthetic cannaboids such as spice or perhaps steroids even are not amongst the drugs that are screened for when a DUI charge is set in place. She also believed he was under the influence of a drug. "This is a case without a blood result, so it makes it a very hard challenge to prove in court", Abrams said, according to KCRA3.

Officers from the California Department of Alcoholic Beverage Control reportedly took a man under arrest for driving under the influence of caffeine. The one positive result was caffeine.

“If thats the case, then they better come and arrest me, ” he joked. But on Wednesday, the Solano County district attorney dropped the charges, saying there wasn't enough evidence to proceed beyond a reasonable doubt.

For myself and many others' sakes, let's hope this man is cleared of any charge.
